What Must Be in a Malaysian Renovation Contract: A Homeowner’s Checklist

A quotation is not a contract. A renovation contract checklist turns a thin quote into an agreement that protects you. Work through a renovation contract checklist before you sign anything. If the only document between you and your contractor is a two-page quote with a total at the bottom, you have no mechanism for handling delay, defects or variations — and those are the three things that will happen.

A renovation contract checklist: the clauses that do the work

Parties and registration. Full company name, SSM registration number, CIDB registration number and address. The entity you contract with must be the entity you pay.

Scope and specification. An itemised schedule with brands, models, dimensions and quantities. Attach the drawings and make them contractual.

Contract sum and what it excludes. State exclusions explicitly. Also state whether the sum is inclusive of service tax, and on what basis.

Payment schedule tied to milestones. Not to dates. "On completion of tiling works" is verifiable; "second month" is not.

Programme with start and completion dates. Plus what counts as a legitimate extension of time, and what happens if there is delay without one.

Variation procedure. Every change priced and signed before the work is carried out. This single clause prevents most renovation disputes.

Defects liability period. A defined period after handover during which the contractor returns to rectify, with a retention sum held until it expires.

Insurance. Contractors' all risks and workers' compensation, with the policy produced before work starts.

Termination. What each side can do if the other fails to perform, and how the account is settled.

The payment structure that protects you

Keep the deposit modest, pay against verified progress, and retain a final sum until the defects period ends. A contractor who wants a large share of the contract sum up front is asking you to fund their cash flow and to carry their risk.
